In 1998, a young man named Eric Brody was hit by a speeding police car in Broward County, causing Eric to suffer a severe brain injury. His later lawsuit resulted in a $30 million verdict on Eric’s behalf. Since the verdict was against a county agency, Florida’s sovereign immunity statute limited Brody’s claim, requiring him to pursue a special act of the legislature to fund payment of his verdict. This is called a Claims Bill. Since the accident, Brody has been wheelchair bound and has been cared for by his parents in their home.
Over the last four years, the family has trudged to Tallahassee in support of a Claims Bill to compensate Eric, only to be disappointed. This year, the Florida legislature finally approved an award of $10.75 million on Eric’s behalf. Why? Because the bill required that no lawyer fees are awarded to the law firm or to a lobbyist on his behalf.
While we applaud the legislature’s enacting of a Claims Bill, it’s astonishing to believe that a citizen who has suffered such catastrophic, life changing injuries has to wait so long and go through so much in order to be compensated for something that a jury clearly found was the responsibility of the governmental agency that handicapped him.
